BION’s (“BION”, “Bionwoman”, “we”, “our”, “us”, “Company”) Website and related services are made available to you in accordance with the following Terms & Conditions, and any other rules posted on our Website. The Website is owned by ASM Greece Co. (“we”, “our”, “us”, “the Company”) of 13 Aghiou Nikolaou Str., Alimos, 17455, Attica Region, Athens, Greece, with VAT no. EL999184706, GEMI no. 8468401000, which will act as the Data Controller together with our parent company, Monachogios Nikos & Sia E.E., seated at the same location.

In addition to the Intellectual property rights mentioned above, “Content” is defined as any graphics, photographs, including all image rights, sounds, music, video, audio or text on this Website. BION tries to ensure that the information on this Website is accurate and complete. BION does not promise that site’s Content is accurate or error-free or that BION Content or the server that makes it available are free of viruses or other harmful components. This Website is for your personal non-commercial use only. Your rights

You have certain rights under the applicable law.
Certain remedies if a product is defective. In this regard, without prejudice to the application of the mandatory consumer protection provisions, all BION products are covered by guarantee for lack of conformity.
Please contact Customer Care department within a period of 1 month from the day when you noticed the fault. In the case of a defect caused from our part, you can choose to replace the product.
Please note that in order to do this, you must have the foresaid BION product in its original packaging, together with the proof of purchase.

The company is not liable in case of incorrect use of the product and any side effects to the consumer as a result of this.
Nothing in this Agreement is intended to affect your rights under the law.
We are not responsible for losses not caused by our breach or negligence, indirect losses which are a side effect of the main loss or damage and which are not reasonably foreseeable by you and us (for example incorrect/wrong use of our products, loss of profits etc.).
We are not responsible for failure to meet any of our obligations under the Terms & Conditions where such failure is due to events beyond our reasonable control.

Compensation

At our request, you agree to compensate us fully, defend us, and hold us BION harmless immediately on demand, its officers, directors, agents, affiliates, licensors, partners and suppliers, from and against all liabilities, claims, expenses, damages and losses, including legal fees, arising from any breach of the Terms & Conditions by you, including the use by any other persons accessing this Website using your Internet account caused by your action or inaction.

Our relationship

You acknowledge and agree that no joint venture, partnership, employment, or agency relationship exists between you and BION as a result of the Terms & Conditions or your use of this Website. You agree that you may not and will not hold yourself out as a representative, agent, or employee of BION, and we shall not be liable for any representation, act, or omission on your part.

No waiver

If you breach the Terms & Conditions and we take no action against you, we will still be entitled to use our rights and remedies in any other situation where you breach the Terms & Conditions.

Governing law and Dispute Resolution

Without prejudice to the application of mandatory provisions for the protection of consumers, these Terms and Conditions and any amendment thereto shall be governed and interpreted in accordance with Greek law, the law of the European Union and the relevant international Treaties.
If any provision is found to be invalid or void, it shall cease to apply automatically, without in any way affecting the validity of the other Terms and Conditions.
If any of the Terms is contrary to law, it shall be ineffective without affecting the validity of the remaining Terms.
In case of disagreement with these Terms of Use, users are requested not to use the website and the Company’s services.
In the event of a dispute between BION and you arising out of these Terms & Conditions, we both agree that the courts of Athens shall have exclusive jurisdiction.
